This is the 18th edition of the Bear Hollow Village Homeowner’s Association Newsletter brought to you by your Board of Trustees. This Newsletter will provide you with an update on things happening in our community and other information.

SPECIAL MEETING – The Special Meeting of the Homeowner’s Association was convened on March 7, 2007. The Minutes of the meeting are enclosed for your review.
Your Board of Trustee’s would like to take this opportunity to thank the membership for their overwhelming vote of confidence and support; we will continue to provide services to the community and membership accordingly.
QUICKBOOKS ONLINE ACCESS - The HOA now uses QuickBooks Online accounting software to record and maintain the majority of the financial records of the Association. Access to the online records of the HOA can be granted to any Owner who would like to view these records from any computer with internet access capability.
Please review the enclosed Association / Corporation Records Review Policy Statement for the guidelines and procedure to follow if you would like to have access to the records.
LANDSCAPING SERVICES – we have renewed the landscaping services contract with High Peaks for the 2007 season. Community clean-up operations from the winter season have started. Nick, Howie and Brian (High Peaks) conducted comprehensive tours of the community to identify areas needing maintenance or enhancement and work lists for Hamlet and High Peaks have been created to help coordinate projects and track their progress / completion.
Here is an overview of some of the services to be provided:
- there will be 3 full time employees on site 40 hours per week each for the majority of the season.
- Part time employees will be added to assist Spring clean-up operations and as deemed necessary for other tasks throughout the season.
- The month of April will be focused on community clean-up and irrigation system start –up and repairs to the system. 3 full time and 2 part time staff are now at work in the community. All lawns are being aerated and raked. Many miscellaneous repairs are in progress.
- The month of May will be focused on planting new tree’s and other landscaping improvements throughout the community. The Village Green damaged lawn area will be re-sodded ( depending on weather this might extend to early June). The bridge over Bobsled Blvd. will be power washed, stained and repaired as needed. The center island across from the mail kiosk and the area around the kiosk building will be re-landscaped to enhance this focal point area of the community. New tree’s will be planted along the south Bobsled entry. The pocket parks will have new shrubs or tree’s added to their appearance.
- Lawn mowing on a weekly basis will begin the end of April or early May depending on weather and growth conditions.
- All lawn areas will be fertilized 3 times during the season.
- Tree’s and shrubs will be fertilized and maintained.
- In the month of June all plant beds will receive a new layer of bark / mulch.
- Weeding of all plant areas will be scheduled monthly during the season. We will also spray for weeds during the season.
- Additional services will be scheduled and provided to keep the appearance of the community in first class condition.
IRRIGATION SYSTEM TURN ON - It is time to turn on the irrigation valves inside the single family homes ( and some townhomes) to start up the system for the Spring /Summer season. All owners who have a valve in their unit have been mailed a Notice by the HOA to turn the valve on no later than May 4, 2007. Your cooperation is appreciated. (Note – if you did not receive a Notice, this does not affect your unit).
VILLAGE GREEN - The removal of the lower pond and re-lining of the stream atop the Village Green appears to have remedied the water seepage into the grass area problem.
We are discussing plans to provide a stone patio area in either the area where the lower pond was removed and filled in or the area immediately outside the pool entrance from the Village Green. Owners comments are welcomed.
CLUBHOUSE - we are adding a second computer to the Club Room. A computer desk and a chair to match as best possible the existing computer desk and chair have been purchased. Owner John Chambers has successfully rebuilt the computer that was vandalized in November 2006 and it is ready to go back into service. A flat panel monitor has been ordered. Once all components are delivered the second computer will be operational, probably in early May.
THE POOL IS SCHEDULED TO OPEN FOR THE SEASON ON
SATURDAY MAY 12, 2007 (weather permitting).
All owners are reminded to please obey the Clubhouse rules and to ensure that their property managers / renters are fully aware of the rules. Please DO NOT send children to the Clubhouse without responsible adult supervision.
The hot tub remains open all year, weather permitting.
THE LODGE UNITS - 35 of the 36 units in Lodge Building A ( directly across from the Clubhouse) are sold and occupied. 24 of the 25 units in Lodge Building C are sold and occupied. Lodge Building D is nearly completed and several of the units are already sold. Lodge Building B is still under construction, units have not been released for sale yet. (Reminder: Owners of the Lodge units are not members of the Bear Hollow Village HOA. However, they do have a dues obligation to the HOA for use of the Clubhouse and other common areas of the community, such as the roads and the Village Green, etc.)
When all Lodge Units are completed there will be 122 additional dues paying Lodge owners contributing to BHVHOA community expenses.
AJC ARCHITECTS LIEN – There remains another lien issue that is impacting 12 individual units / owners in Bear Hollow Village, the parcel of land that is now the site of the Clubhouse and the parcel of land that is now the commercial office building, that was filed by the company AJC Architects, who did work for the original developer, now bankrupt. Attorney Darren K. Nelson is representing these owners to reach a negotiated Settlement in this matter on behalf of First American Title Insurance Company.
The specific units involved in the AJC Architects matter are as follows:
T41 -T42 -T43 - T53 - T54 -T55 - T102 - T103 - T104 - T105 - T106 - T107
Howie contacted Mr. Nelson for an update and was advised depositions from AJC representatives and others as necessary are scheduled for May 2007. Motions for Disposition of the matter should be filed and completed in July 2007.
VOLUNTEERS NEEDED !
Your Trustee’s are requesting Owner volunteers to staff the following Committee’s:
GROUNDS COMMITTEE - this Committee is formed and in place. Several owners on the Committee are assigned specific areas of the community to maintain a watchful eye on things and report any conditions that need attention or maintenance to the Trustees.
The Committee members send an email or telephone call to the Trustees weekly (or as needed) to report problems or advise everything is OK. The existing Committee members are doing an excellent job and would welcome more owners to their ranks.
CLUBHOUSE COMMITTEE – this Committee needs to be formed. Duties will include keeping a watchful eye on the Clubhouse building, its contents and the grounds within the fenced in pool area and reporting any problems or maintenance issues to the Trustees.
The Committee members will also be asked to assist with decorating the interior of the Clubhouse during holiday seasons; all decorations will be provided by the HOA.
DESIGN REVIEW COMMITTEE - the Trustee’s are currently performing the duties of the Design Review Committee which include the review and approval /denial of any
Projects that change the exterior of an owners property in accordance with community rules and the Development Agreement. Hamlet professional staff assist the Trustees as required for any significant projects. We would like full time residents, especially anyone experienced in law, architecture, engineering or real estate to volunteer for this Committee.
Any Owners interested in volunteering for any of the above Committee’s are asked to contact any of the Trustee’s for further information and assignments. Thank you in advance to all volunteers, and a special Thank You to our existing volunteers, keep up the great work !!
THE BIRDS PROBLEM - last year, parts of the community were “invaded” by birds called “Barn Swallows” who migrated across Route 224 from the Swaner Nature Preserve and established nests in the roofs and eaves of several homes in our community, especially homes along Cross Country Way and Bobsled Blvd. near the wetlands area. These birds are protected by federal Endangered Species laws and fines are significant if the nests are removed when the birds are occupying the nests and laying their eggs. Therefore, it is important for owners to keep a watchful eye on their property to remove any nesting activity in its early stage ( before the birds occupy the nest). The HOA will assist in keeping watch to identify problems but it is the individual owners responsibility to remove the nests from their private property. Owners must clean up their properties in accordance with the HOA “No Unsightliness Policy”.
EMERGENCY CONTACT INFORMATION - the Association has requested that ALL owners provide an emergency contact person who would be available to grant access to their unit in an emergency situation. About 60% of the Owners have sent in their form. If you have not done so, please take a moment to complete the form and send it to Howie. The Emergency Contact Form can be found on the HOA website http://www.bhvhoa.com/ .
REMINDERS – there are numerous new owners in our community and we would like to provide everyone with some general reminders and information, as follow:
- the HOA only provides insurance for the Common Areas, all owners are
responsible for insuring their private property residences and grounds.
- maintenance and repairs to your private property residences and grounds are the
responsibility of each individual owner, not the HOA. ( There are some
exceptions, such as the sprinkler system and the grass / shrub areas maintained by
the HOA for the benefit of the owners.)

- LOCALS SKI PASSES – as a Utah property owner you are eligible for discounted “locals” ski passes at most of the area ski resorts. Generally, you are required to sign up in person and provide proof of Utah property ownership ( with a tax bill or utility bill in your name) when first enrolling. After that, you can usually keep your passes current via the internet. Each resort has a different program and sign up before September is the norm; contact the resort of your choice for more information, savings on ski passes are considerable, do not miss the opportunity to save substantial $$$$ on the cost of tickets.
