POLICY STATEMENT

 

TRASH COLLECTION POLICY

 

 

PURPOSE:

 

This Policy Statement will outline the guidelines established for the removal of trash in the containers provided for all Units and residents within Bear Hollow Village.

 

AUTHORITY:

 

In accordance with Article’s 3.16 , 4.1g and 4.1q of the Second Amended Restated and Confirmatory Declaration of Protective Covenants, Conditions, and Restrictions for Bear Hollow Village (CCR’s) all Owners and residents are obligated to maintain the appearance of their properties.  The Board of Trustees for the Homeowners Association is empowered to promulgate Rules & Regulations for the regulation of  the community and to initiate enforcement actions for violations of the CCR’s  and the Trash Collection Policy.

 

RULES & REGULATIONS

 

  1. All household trash for disposal must be placed curbside for collection in the container provided.  Placing of additional trash curbside outside the container provided is prohibited.

 

  1. No trash containers can be placed curbside for pickup earlier than 12:00 Noon the day before trash collection day.   Normal trash collection day / time is TUESDAY morning in Bear Hollow Village. 

 

  1. All Units must utilize their own trash container.  Placing your trash in another Units container without the permission of the Unit owner is prohibited.

 

  1. No residents will dispose of Unit trash in any of the Common Area containers

placed around the property by the Homeowners Association or in the dumpster

provided for the Commercial Building tenants.

 

 

  1. Tenants of the Commercial Building must dispose of their trash in the dumpster provided for this purpose.  All commercial building trash must be placed in the dumpster by tenants / occupants.

 

  1. After  collection, empty trash containers must be removed from curbside no later than 7:00PM after collection and placed either inside the garage of the Unit or in a location immediately adjacent to the property so as to be as inconspicuous as possible.  NOTE: the Homeowners Association will assist owners by providing service to remove empty trash containers from curbside after pickup, however the primary responsibility for removal of the empty trash container remains with the property owner.

 

  1. Residents who require additional trash removal services must make their own

arrangements for additional trash pickup /removal with the appropriate service provider.

 

ENFORCEMENT

 

Unit Owners in Bear Hollow Village are completely responsible for the actions of themselves, their family members, guests and renters utilizing their Unit.  Enforcement actions by the Board of Trustees will be against the responsible OWNER.

 

The Board of Trustees are empowered and authorized by the CCR’s  to assess fines, suspension of Owner privileges, or any other action deemed appropriate, in their sole discretion, for violations of the Trash Collection Policy. 

 

Fines, suspensions or other enforcement actions by the Board of Trustees will be commensurate with the type, severity and / or frequency of the violation cited.

 

Residents observed in violation of the Trash Collection Policy as outlined herein will receive a written Notice of Violation from the Board of Trustees, or their designee, for a FIRST OFFENSE.  The Notice will identify the violation date and circumstances and request the Resident to cease any future similar violation actions.

 

Residents observed in a SECOND OFFENSE violation of the Trash Collection Policy as outlined herein  will receive a written Notice of Violation from the Board of Trustees, or their designee, identifying the violation date and circumstances and advising that a FINE

of $25.00 will be imposed upon the Unit Owner responsible for the property where the violation has occurred.

 

Residents observed in a THIRD OFFENSE violation of the Trash Collection Policy as outlined herein will receive a written Notice of Violation from the Board of Trustees, or their designee, identifying the violation date and circumstances and advising that a FINE

of $100.00 will be imposed upon the Unit Owner  responsible for the property where the violation has occurred.

 

ALL subsequent violations of the Trash Collection Policy by a resident after a Third Offense will result in a FINE of $100.00 imposed upon the Unit Owner  responsible for the property where the violation has occurred for each subsequent offense.

 

All monetary fines assessed against an Owner for violations of the Trash Collection  Policy are deemed to be payable in full when recorded to their accounts and billed to the owner along with the  regular monthly dues Invoice.

 

 

This updated Policy shall become effective MAY 15th, 2006.
