Policy Statement
Vehicle Rules and Regulations Policy
PURPOSE:
Vehicle Rules and Regulations are designed to manage the presence of vehicles within Bear Hollow Village. The objective is to protect all owners, tenants, visitors and property as well as to maintain the aesthetic values of the community and safety of all persons in Bear Hollow Village.
AUTHORITY:
Vehicle Rules and Regulations exist under authority granted by Article 4.1(k) of the Bear Hollow Village CC&Rs dated March 2004.
These Vehicle Rules and Regulations apply within all areas of Bear Hollow Village. This Policy may be supplemented with more-restrictive, but not less-restrictive, Vehicle Rules and Regulations issued by the three individual Condominium Associations for their own properties.
This Policy does not apply to the Declarant / Developer during the development period.
DEFINITIONS:
Alleys – Cross Country Way Biathlon Loop Freestyle Way
Curling Court Polar Way Kodiak Way
Grizzly Way Slalom Way
Private Roads- Lillehammer Lane & Luge Lane
Public Roads- Bobsled Blvd and Oslo Lane
Private Property- Units owned by individual members of Bear Hollow Village as defined
in Article 1.17 of the CC&Rs
Common Areas- Real property owned by the Association as defined in Article 1.5 of the CC&Rs.
RULES AND REGULATIONS:
All portions of the Utah Code, Title 41, Motor Vehicle Act, as amended, are fully enforceable within Bear Hollow Village. All persons operating motor vehicles within Bear Hollow Village must adhere to all motor vehicle laws of the State of Utah.
All Summit County Vehicle and Parking Ordinances are fully applicable and enforceable in all areas of Bear Hollow Village.
Motorized vehicles shall be operated within Bear Hollow Village only on improved roadways or driveways.
No snowmobiles, recreational vehicles, unregistered motorcycles, construction vehicles, golf carts, go carts, farm equipment, campers, ATVs or other such off road vehicles may be operated or parked within Bear Hollow Village except during periods of actual loading or unloading for transport to or from a Unit. Vehicles described in this paragraph will not be repaired, maintained, kept or stored outside anywhere within Bear Hollow Village.
No water craft and/or their trailers can be stored or parked outside on any private property, alleys, roads (private or public) or on Common Area within Bear Hollow Village other than for actual loading and unloading for transport to or from a Unit.
Vehicle parking is not permitted at any time on the roads designated as Alleys in Bear Hollow Village as required in the Summit County Development Agreement.
Vehicle parking is not permitted at any time on the EAST side of Bobsled Blvd.
Vehicle parking is permitted at all times within the bulb out (indented) parking areas on the WEST side of Bobsled Blvd.
Vehicle parking is not permitted at any time on the WEST side of Lillehammer Lane.
Vehicle parking is permitted at all times within the bulb out (indented) parking areas on the EAST side of Lillehammer Lane between Bobsled Blvd. and Luge Lane.
Vehicle parking is not permitted at any time on the SOUTH side of Luge Lane.
Vehicle parking is permitted at all times within the bulb out (indented) parking areas on the NORTH side of Luge Lane between Bobsled Blvd. and Lillehammer Lane.
All vehicles parked on any public or private roads in Bear Hollow Village in accordance with this Policy must be parked parallel to the curb and facing in the correct direction of traffic flow for the side of the street on which the vehicle is parked.
There is no parking of any type of vehicle within Bear Hollow Village on undeveloped private lots. Utah Code 41.6-116.1 allows for the removal of a vehicle on private property if the vehicle is considered “abandoned.” A vehicle is considered as “abandoned” if it is on the property for more than 7 days without the specific consent of the owner.
Inoperable motor vehicles shall not be parked anytime within Bear Hollow Village. Motor vehicles requiring emergency repair must be dealt with immediately for removal off-site. No “unsightly” motor vehicles, or motor vehicles which cannot be legally operated on a public road, shall be parked outside at anytime or anywhere within Bear Hollow Village.
No commercial or other vehicle registered for greater than ½ ton vehicle weight can be parked overnight (10PM to 6 AM) anywhere in Bear Hollow Village. Commercial vehicles registered for a maximum
½ ton vehicle weight must be parked overnight in a garage at any Unit that has a garage facility. A full-time owner resident of a Condominium property in Bear Hollow Village, without a garage, having a commercial vehicle registered for ½ ton vehicle weight may park a maximum of one (1) vehicle of this type in one of the Condominium parking spaces.
Construction trucks and/or trailers for remodeling of Units can be parked overnight in Bear Hollow Village only during the period of remodeling and then only in the driveway of the Unit being remodeled.
Special one-time parking needs may be brought to the attention of the Bear Hollow Village Board of Trustees, and will be considered on a case-by-case basis.
ENFORCEMENT:
The Board of Trustees shall have the right to promulgate reasonable parking rules and regulations affecting roads, Common Area and private property in Bear Hollow Village. The Board of Trustees can also assess fines against any violator and/or have any such vehicle removed if in violation of promulgated rules and regulations. All fines for violations of the Vehicle Rules & Regulations and all expenses incurred by the Homeowners Assn. for enforcement actions will be assessed to the Unit owner associated with the vehicle in violation of the Vehicle Rules & Regulations Policy as a regular Dues Assessment and must be paid in full.
Unit owners are responsible for providing notification to property management agents, long term tenants or nightly rental tenants of the Vehicle Rules and Regulations Policy in Bear Hollow Village.
Violations of these Vehicle Rules and Regulations may be reported by any person in Bear Hollow Village to the Board of Trustees or their designee. The Board of Trustees will assess fines and/or tow the vehicle in violation of posted parking rules or violations made known by Notice or otherwise to vehicle owners / operators, depending on the specific violation and circumstances and at their sole discretion.
Any vehicle being operated in an unsafe manner or in violation of Utah motor vehicle laws will be identified to the Summit County Sheriff for appropriate and immediate enforcement action.
Alleys, Roads, & Common Area Violations:
A vehicle parked on Bobsled Blvd. in violation of the Bear Hollow Village Vehicle Rules & Regulations Policy and the posted No Parking signs will be towed at the expense of the vehicle owner.
A vehicle parked on Luge Lane or Lillehammer Lane in violation of the Bear Hollow Village
Vehicle Rules & Regulations Policy and the posted No Parking signs will be towed at the expense of the vehicle owner.
A vehicle parked on any road designated as an Alley in Bear Hollow Village in violation of the Bear Hollow Village Vehicle Rules & Regulations Policy and the posted No Parking signs will be towed at the expense of the vehicle owner.
A reasonable effort will be made to notify the owners of vehicles parked elsewhere in Bear Hollow Village in violation of the Vehicle Rules & Regulations Policy that removal of the vehicle from Bear Hollow Village by towing is about to occur.
Private Property Violations:
A vehicle on private property in violation of the Bear Hollow Village Vehicle Rules & Regulations Policy will have a Notice placed on it describing the violation and requesting an immediate resolution. If there is no resolution within 24 hours a written notice will be sent to the owner of the property requesting immediate action/s/ to resolve the violation cited. The property owner is responsible for correcting all violation/s/ occurring on their property regardless of the ownership of the vehicle on the property.
If the cited violation continues for 7 calendar days after the date of the written notice, the Homeowners Assn. will impose a fine of $50.00 a day , for each day the violation continues, on the property owner where the vehicle in violation is located. The property owner will be notified by the HOA in writing of the date fines commence and the date they are terminated (when the violation ceases). Fines will be added to regular Dues Assessments and must be paid in full.
This Revised Policy is effective commencing October 1, 2005.
ADDENDUM #1
OSLO LANE PARKING RULES
Vehicle parking is permitted at all times within the bulb out (indented) parking area and on the NORTH side of Oslo Lane near lot 38 (5598 N. Kodiak Way).
Vehicle parking is permitted at all times on the EAST side of Oslo Lane between the area bounded by T150 (5680 N. Oslo Lane) and the site of the Bear Claw Condo building.
Vehicle parking is not permitted at any time on any other area of Oslo Lane as per the posted signs.
ENFORCEMENT
A vehicle parked on Oslo Lane in violation of the Bear Hollow Village Vehicle Rules & Regulations Policy and the posted No Parking signs will be towed at the expense of the vehicle owner.
This ADDENDUM #1 to the Vehicle Rules and Regulations Policy shall become effective May 15, 2006. Policy language corrected January 1, 2008.
